  • H1B amendment I-129 Denied

    Hello All,

My H1B amendment current status is I-129 denied. I did a location change for the same client.
I have VISA validity till next Sept 2017. I am yet to get the reason notice.
What all are my options available ? Am I eligible to stay in US ?
Should I go back to my old location and work from there ?
Can I stay in my current location and raise a new petition ?
Is my VISA and old petition still valid ?
Which is the safest option I should ask my employer ?
Note : there is no change in my current employer and client. The change is only on location.
But I did not worked on old location. I raised the location before travelling to US itself and traveled with new petition number.

    Thanks&regards,
    AS

So you never worked at the location originally approved, but traveled to a location without actually getting approval for the new location?

Yes. So should I travel back to the old location ?
How long I can stay in my current location after the denial ?

I don't really think you can travel back to old location and start working as if nothing happened. I believe you have to leave US and re enter with am approved petition.

This is my opinion not legal advice.
