H1B extension on I-140
Hi,
I have 2 questions..
1) My VISA expired on 9/29/2016 and have an approved extension till 3/2/2017 which is also the Max out date. I have I-140 approved but my extension process has not started yet. I believe it is taking more than 5 months now. If my extension is still in process and and is not approved before 3/2/2017, Do I need to leave the country? or Can I stay until I get an response from USCIS on the extension filed?
2) My wife who is on H4 went to India now. Does she needs to be here while her extension(I-539) is being filed?
