1 year break and travel the world on H1B

  • 1 year break and travel the world on H1B

    Hi,

    My wife and I are on H1B status. (approved and stamped for 3 years)
    We are still having 2 more of years of H1B validity.


    My wife is working full time with an US employer. And her employer filed green card also(i140 approved)
    I am working as an consultant for an US employer.


    We really love travelling and want to take a break for a year and travel the world.
    But we are not sure what will happen to the current status and green card process after our return to US?
    Will the same H1B be valid or we have to apply for a new H1B?

    I googled and searched the forum but unable to find a question like this.

    Can some one please help us with the above queries and also what is the best way to take a one year break without losing everything and doing all over again?

    Are your respective employers fine with it and will be willing to re employ after a years gap?

      Not sure raghvi. We didn't ask our employers yet.

      Before saying to them I just want to know what are all the options we have?

      If they say yes should we resign and come back again by lottery and H1B?

      And what if they say no?

      what we can do in each case?

        Well if they are fine with it, then you can leave and re enter at the decided time with a valid H1 visa and latest employment letters.

        If they are not fine, you would need to find new employers who are willing to file cap exempt H1 for you.
