Hi,
I'm on H1B visa working in the US.
My visa will expire in December 2018.
My husband's i-485 is being processed on EB2. His check was encashed by USCIS and he received i797 for i131, i485, i765 yesterday.
His Finger printing will be done on Nov 16.
My i485, i765, i131 were filed just two weeks ago as a beneficiary / dependent. USCIS has NOT encashed my check as yet.
My project ends 23 Dec 2016. If I do not get a project by Dec 31 2016, I need to travel back to India.
If my i485, i765, i131 are NOT approved before Dec 31, 2016 - Questions:
1) What is the implication on my GC process ?
2) What are the options I have to prevent any untoward from happening to my GC process ?
3) Can I convert H1 to H4 until my i485 is approved ?
4) If I have to apply for H4, when should I apply by?
5) Will applying for H4 cause any problems to my GC ?
Please help. I'm really tensed.
