In the month of Nov 2015 , I switched from employer A to Employer B with an approved I797 document (Transfer version) for me and my spouse (H4 dependent) . This I797 was valid from Nov 2015 to Dec 31 2016 . During Jun 2016 , I applied for an extension in Premium and my extension got approved from Jan 1 2017 till Nov 2018. Due to some personal reasons , I had to travel to India in Aug 2016 and I appeared for stamping throughdrop box in Chennai location along with my wife and we got our H1 and H4 Visa stamped through Employer B and the expiry date was Dec 31 2016 . This stamping was based on I797 (Transfer Version) as I had plans of returning back in Sep 2016 . So my employer B asked me to stamp I797 (Transfer Version) . During my entry into USA ,Customs officer looked at my Visa and provided me an I94 expiry date as Jan 10 2017 as my Visa in the passport was expiring by Dec 31 2016 . Now , is my status illegal after Jan 10 2017 ? How can my update my I94 and I have a approval notice for the time - Jan 1 2017 till Nov 2018.
