  • H1B Visa I-94 Extension

    Hi,

    I am on H1B Visa valid untill 2017 March.I switched my employer and got new I979 approved untill Jan'2019 with my I-94. After the approval i traveled to India and came back my I-94 number changed and vailed untill 2017 March.

    Can i legally stay in US with my old I-94 even after new my I-94 expires.

    Please advice!

    No. You should have returned the I94 that came with the I797. Your employer needs to file extension using form I129.

      single I-539 application had 2 dependents details

      Hi, I have filed H4 extension for my husband and son in a single I-539.
      My husband moved out of US with in 120 days , so his extension got denied. But still my son is in USA and his petition is still in process.

      Please let me know since my husband visa is denied , will my son's visa also will get denied?

      If he stay more than 240 days after his I-94 Expiry date, is thr any legal problem will arise (since he is just 6 years old) or he has to move out of US?
