  • H1B Cap Exempt !

    Hello,

My H1B filed from an employer in 2015 quota and Visa will be expired by 31-Dec-2016, I have not traveled to US during this period
My Current employer saying that, My visa will be expired and I need to re-apply for next year CAP .

    1. Is my case fall under CAP Exempt?
    2. Can I transfer my Visa to other employer at this stage?

    Regards,
    Ram

Your h1b visa can be used for 6 years. you don't need to come in cap next year. you can transfer. Do you have the petition # and details?
