  • H1B/L1/Approved I-140 - H1B Cap Exempt?

    Hi,

    Details: I was on H1B from 2006-2012. At the end of my 6 years, my employer transferred me to Canada for a year. My I-140 got approved in December 2012. In 2013, I came back from Canada on L1 (rather than on H1). I have been on L1 since then.

    Question: I want to change back to H1, am I still eligible for an H1 extension based on my past H1B?

      Hi,

      None actually; used my entire 6 year limit by 2012. Although when I was coming back from Canada in 2013 (after an year outside), our lawyers advised me that with an approved I-140, I was eligible for a 3 year H1B extension.
