Could someone help me with the following scenario:
I received my H-1B on October 1st with an LCA for Boston, MA.
However, I was then deployed (October 10th) to a client in IL for 4 days a week, and an LCA wasn't filled based on negligence.
Now, (Jan 22) I was made aware about requirement of an H-1B amendment. However, before the amendment is filed, the attorney wants me to go to my home country to get stamped (I haven't had it stamped for the H-1B obtained on October 1st)
Questions:
1. Am I out of status?
2. Do I need to get my passport stamped before the H-1B amendment? or does the H-1B amendment need to go through before I leave the country?
