  • H1B Travel with an Approved Extension & I-140

    Hi,

    I am on H1B Visa with an approved I-140.
    My first H1B Term was valid until April 30'2014 and so was my visa Stamp.

    My second H1B term has been vaild until April 30'2017.
    My employer is planning to file another extension by 28th Feb '2017 under premium processing.

    I have to travel to India from 8th March until 20th March.

    My question is
    1) Can i use dropbox as I am with same same employer since 2011
    2) If i get H1B Stamp , it will be based on current I-797(April 30'2017) or latest approved I-797(April 30'2020)
    3) When I enter USA, at POE I'll get I-94 based on current I-797(April 30'2017) or latest approved I-797(April 30'2020)

    Any chance of complete denial of H1B due to travelling at the end of H1B period?

    why not just apply for the extension here. As long as you were physically present in the US at the time of filing, your petition will not get rejected for that reason. If you do consulate notification, you will get a visa validity period of what you put on the petition. and the I-94 will be based on what you show the officer.
