  • H1B Cap Exemption - Information

    Hi ,

    My H1B Extension got denied for client A on May 2017 and i had to travel back to India since my i94 was expired on Oct 2016 . My New client B from the same employer is planning to file a H1B Cap Exempt for me to travel back to US again .

    1) Can anyone clarify me if H1B Cap exemption be filed now for client B since my extension denial happened on May 2017 ( though denial was for a different client A)
    2) Is there any cooling period from my denial date before which i will not be able to file my H1B Cap Exempt .
    3) How long does H1B Cap Exemption take to get approved .
    4) And should H1B Cap Exemption be filed within one year from your visa end date ( OCt 31,2016 ) else does H1B Cap exemption becomes void .

    Any clarifications on the above questions will be a of great help .

    1. Yes cap exempt H1 can be filed.
    2. No.
    3. 2-4 Months if no RFE.
    4. No such limit.
