  • Laidoff: 60 day grace period ending soon. Few questions

    Hello

I got laid off July 05 2017 and my 60 days grace period ends 3rd of September. By the time I find and employer and file for LCA and I-129, it will be past the 60 days grace period. I have couple of questions:

    1. Would there be a problem if I apply for B2 visa since I have approved I-140. Is there any other visa other than F1 or B2 that I can apply?

    2. If I apply for COS (to B2 Visa) before the 60 days, can I continue to stay?

    3. If I apply for B2. And apply for H1B transfer with new employer, would it clash with each other? If H1B transfer is approved, would there be any issue when I go for visa stamping since I had applied for B2 as well?

    4. If I overstay (undocumented) without filing COS, what problems would there be when I file for H1B transfer, or getting H1 stamped or filing for GC?

    5. My current H1B visa has already expired but my I-94 expires end of February 2018. After the transfer will my new H1B be valid until end of Feb 2018 or 3 years from now.

    6. What is the current H1B transfer process time? When can I start work?

    I appreciate any response.

    Thank you
