    Hi All,

    I worked for a Company A and was laid off on August 1, 2017. I am on my H-1B visa (with my I-140 approved with Company A). Because of the new 60 day grace period rule, I understand that I have 60 days(until September 30, 2017) to find a new employer who would sponsor me H-1B and file a H-1B transfer petition. My question is that, will it be sufficient if the new employer(Company B) files a H-1B transfer petition by September 30, 2017 or should I also start working with the Company B by September 30, 2017. Because with premium processing suspended it could take 2-3 weeks to get the H-1B transfer receipt.

    During the H1B 60 day grace period, you won't be considered "out of status" for nearly two months after you have lost your job. By doing so, you will have the opportunity to look for another job or apply for a visa change.
