Do we need old H1 for I-140 H1 ?

Hi,

I was on H1 and went back completing 6 years. My old H1 was having just 45 days left. I am back as a dependent. If I have a company file my perm and I-140, would I need the old H1 to be transferred to the new company ? Or would the H1 after I-140 be a new one cap excempt ? Please assist.
