H4 Visa transfer to H1B
Hi
My spouse is on H4 Visa and she is working on H4 EAD.
Now, she wants to transfer the visa from H4 to H1 on this new H1B Cap 2018-19. I have questions
1 ) If H1B New petition will be denied then can my wife stay continue on her H4 Visa and work it here on her H4 EAD? Any effect on her status?
2.) If H1B New petition will approve then automatically from Oct-1st, 2018 , she has status on H1B Visa. but after approval again she can go back to her old status H4 and apply for H4 EAD ?
3.) during this H1B Process, can she go to India on her H4 Visa?
