Can we apply for H1 transfer and H4 simultaneously
I came to US on H4 Visa in 2009(not valid now). Later, I moved to F1 and got a H1B. I've been working on H1B since October 2014 (expiring H1B and I94 on Jul 1st 2018). We are applying for a H1 transfer with extension in a week. We have few questions regarding scenario.
1. Can we apply for H1 transfer and H4 (H4EAD) simultaneously? In case if we can apply-
? What if H1 is processed first followed by H4 extension and both get approved?
? What if H1 transfer is approved first and then H4 is approved?
? Should I not apply for a H4 at all?? - considering the fact that H1b will be applied. In case if the H1b is not approved and I94 will be expired by the time we get the H1B result. (we are not sure if we are going to get an approval based on the educational background because I has a master?s degree in Biotechnology and has been working in computers.)
2. Since I was holding H4 when I initially entered US, should we still apply for H4 or is there a way we could bypass the step of applying H4?
