  • H4 - Passport expires before visa

    Hi,

I need help/suggestion on the below:

    Here is my situation:
    ------------------------

    1. My son entered USA with us on Aug 26th 2016
    2. H4 Visa is valid until Feb 2019 (As per the visa sticker in passport)
    3. Passport expires Aug 5th 2018
    4. At port of entry, they put a rubber stamp saying "Admitted"
    5. On that rubber stamp, there is "Class" and "Until" fields.
    6. They hand written class as "H4" and "Until" as Aug 5th 2018 (Which I believe to be the i-94 date and I think they pick that date based on passport expiry date).

    Actions Taken so far:
    -----------------------
    1. Applied and got a new passport from Indian Consulate/CKGS

    Questions:
    ----------
    1. Do I have to reach out to USCIS to apply and get a new date?
    2. Or else go to a nearest International airport and see whether TSA can do anything about this?

Thanks in advance for any help/suggestions!!

    Regards,
    Ramesh

Neither. You would need to go to the nearest border point, and CBP will renew the I94. Please see the thread on this forum regarding the same, wherein users have described, in detail, their experiences with renewing I94 at various border CBP offices, for e.g., Laredo, TX.
Just an opinion; Not legal advice.

Thank you, I will go to the nearest CBP at my place (LA).
