  • Correction is H4 start date and possibility of being out of status

    All,

    My situation below,

I was on H1B and lost my job on 27th April 2018. My wife is on H1B and her current petition is expiring on July30th 2018. So we applied for her 3 year extension in premium processing and got approved for H1b along with my H4 starting from July 31st 2018. As I lost my job on 27th April 2018 and I have 60 days grace period and I assume I would be covered till 25th of June. And after that I will go out of status as my H4 start date is July 31st 2018.

I have contacted the attorney and asked them to reach out to USCIS to correct my H4 start date which was from 5th May.

In this kind of above scenario what is my best option.

    1. Wait to hear back from USCIS to correct the start date of my H4. And not sure how long this will take time. If they correct before 25th June then I am back in status.

    2. If we don?t hear back from USCIS before 25th June than is it safe to exit out of country and get stamped for H4 and return.

    3. if Step 2 is what is safe, than will the stamping in the US consulate for my visa will start form 31st July based on my wife petition start date or will the H4 start date will be from the day of the interview in the US consulate.

    4. Should I go to my home country for stamping or is it a good idea to go stamping in some other country other than my home country.

What is the best and safe options I need to consider.

    Please suggest.
