H4 Extension filed when dependent was outside US.
My employer filed my H1-B & H4 extensions petitions. But due to a personal emergency my spouse had to travel back to my home country. And in meantime petitions were filed.
So I understand the current I539 filed is not valid as mt spouse was physically not present in US at time of filing.
My questions:
1. Can my spouse travel back a week before the current visa expires?
2. Should I file a new I539 once my spouse is back to US? Or is there any way to update the I539 that is already filed by my employer with new I-94?
