  • H1 - B amendment for promotion - How risky is it under current administration?

    Hi,
    In my company the policy for foreign nationals has always been to file an H1-B amendment whenever they get promoted, even if its within the same team ex. from Data Analyst to Senior Data Analyst. Since it has been the immigration policy of the company I dont think they will change it and now I am looking at a promotion, which means they will file an amendment for me.
    My question is - with the current strict administration and recent rule stating that RFEs need not be issued and H1 petitions can directly be rejected by USCIS officers, how risky is it to go forward with the H1-B amendment? Has anyone who has filed recently for H1 amendment for a promotion been issued with RFE or denial? People who have been in this situation in recent times or have seen others who have, please help me out and advise me based on your experience.
