  • H1b Transfer Pending & Visa Stamping with current Employer.

    Hi Members,

    Thanks in Advance.

    I have a question regarding H1b Transfer.

    Currently I am working with Employer A. My I-797 is valid till 2021. My previous visa stamping on my passport is with the same employer A expired in 2018.
    I am planing to visit India "my home country" for some family emergency. If I visit India, I need to go for Visa stamping.
    But I recently got a job offer with Employer B and my Visa transfer is pending. I can?t request for premium processing at this time. So it might take another 3-4 months, depending on USCIS.

    I will be working with Employer A till Employer B transfer my H1b successfully.

    My concerns are:
    Is it safe to travel India with my current situation ?
    If I must travel, can I go for stamping with my current employer A ?
    Do I have to leave country and re-enter once I move with Employer B ?

    Any suggestion will be appreciated.

    Since you haven't left job from Employer A, yes you can still get the stamping done using your current I797.
