Can I use my previous I-797?
I entered the US on dependent visa. A company X applied for my H-1 while in the US, which was approved in Feb 2005. But I joined another company Y since the company X couldnot find projects to place me. The Y company applied for my visa and it was approved in October 2005 and I have worked for them until October 2006 (last week) when I got laid off. I am visiting India next month and have already scheduled H-1 visa appoinment in Chennai (India) in December using petition from company Y.
Now since I am not working for company Y, can I use petition X which is still valid (I have verified). The company X is now willing to find projects to place me on their pay roll again.
Can I use company X's petition to apply for visa when I visit India? Please let me know if further information is needed to answer my question. Are there any other options that I can consider?
