  • Fresh H1 after 6 years of stay in US

    Hi,

    I will be completing my 6 years of stay in US on H1B in April 2007. My company is trying to see if they can extend my visa but if it does not work out in the next two months, i want to go back to my home country in Dec'2006. I want to come back to US after spending 1 year out of US.

    Now, can I apply for a fresh visa under 2008 quota in April 2007 so that I can come to US in December 2007?

    If yes, are there any things that I need to be ware of.

    If no, what are the reasons this cannot be done. Theoritically it looks ok to me I have not found much information on a fresh H1 visa after maxout.

    would appreciate if some one can throw some light.

    I think you need to stay out of the US for 2 years to apply for a fresh H1. I would suggest applying for a new job in your home country. Dont stick with your current employer in your home country as well. As there may be many more lucrative opportunities. Take it easy there.. enjoy time with family and friends and if you really need to get back.. the road to H1b will always be open.
