H1B Quota Issue
Hi Folks,
I have an expired (in June-2003) H1B visa. This visa has never been used. I mean it is unstamped and I never work in US using that visa. "Company A" has got me the visa in 2000 but couldn't get any project for me.
At present, I am working in US on TN visa (as Canadian Citizen) and my "Company B" wants to apply for my H1B visa. But, as the H1B cap has already been reached for this year, my "Company B" can apply only in April 2007.
Now, my question is ...
Am I subject to H1B Visa Cap? Can my "Company B" apply for H1B sooner than April 2007 based on my previous H1B visa with "Company A"?
I will highly appreciate your reply or suggestion.
