Hi all,
I work in one of the indian software companies.They had filed H1 for me in 2005 quota.It got approved in Sep 2005.
But in the approved H1 petition my name was different w.r.t passport.
My first,middle and last names got interchanged w.r.t to passport.
So I had sent the H1 approval for recitification.(amendment) in Oct 2005.
I got married in dec 2005 and my husband stay in US.He works as a consultant.We were waiting for amendment to come but it didnot come for long time.Later in july 2006 i took H4 visa and reached US.
We thought on taking a fresh H1 in 2007.My husband employer is ready to file h1 for me and I can work from Oct 2007.
But his employer has given one more option that he can transfer H1 from the existing H1 approval which I already have with me.
I have the following queries regarding this.
1) For the existing H1 approval my name is different w.r.t passport.Will it create any problem?
2)For the same H1 petition, already amendment process is going on.So can I file a transfer with the petition
3)That approval is valid since Oct 2005.But i never used and worked in US.Is it ok if I use that H1 approval for applying transfer through a employer.
Please help me and let me know any risk if I apply H1 transfer.
