    Could you please let me know whether an H1B visa holder can start a company in the United States of his own while working for his employer.

    You need to have a GC at the minimum to incorporate. However, if you have a partner (relative) who has a GC or citizenship, he can be the proxy owner for the meantime and do the incorporation.

    Better to talk to a CPA for state and local tax laws.

      Or you could start a company without any restrictions in your home country e.g. CompanyXYZ. Ask your clients to pay checks in the name of the company and deposit those checks in your home country's company bank account. e.g. ICICI bank would have an account for your company. Just deposit those checks in that company's account in ICICI bank. You would need to pay tax in your home country.
