Hi, I came here on H4 and after coming here my spouse transfered the H1B from company 'A' to company 'B'. Now she got the approval notice. But at the time of H1 transfer we didn't applied for I-539. My H4 visa and I-94 is valid untill 09/2008. Is it necessary to apply I-539 in the case of H-1 transfer? I am going to apply for my H1B in April. If I apply for change of status(I-539) now and with in 20 days I have to apply again for another change of status(H4 to H1B) is it OK? Which one is best in my case. Please advice me ASAP. I have very less time to take decision.
