L1 stay + H1 Stay = 6 years?

G'Day All,
I Stayed in US from Oct 2003 to Aug 2005 (22 months) , then went back to India stayed for 7 1/2 months. Came Back to US on March 15 2006(On H1 issue don nov 2005).


Now my H1 tenure will be for 6 years ,


i.e from Nov 2005 - Nov 2008( 3 years)

+ (Renew)

Nov 2008 - Nov 2011 ( 3 years)





Or....



Since I stayed for 22 months on L1 prior my H1 stay and didn't took gap of an year in India came back to US on H1, so would H1 is given for 4 years.


i.e Nov 2005 - Nov 2008( 3 years)

+ (Renew)

Nov 2008 - Nov 2009 ( 1 year)






So Can i stay continuosly for 6 years or INS takes in to consideration of my L1 stay (22 months ) prior to H1 and gives only for 4 years?




I would be really Great ful for going through the above and responding.
