out of Status on H1?

I came to the US on H4, got my H1 approved in Oct 2006, worked for 2 months, went on vacation for a month and got my H1 stamped, but couldn't find another job for the past 5 months, my employers are not paying me on bench, am i out of status, how long can i stay like this?
