    i had a H1 B approved from company X when i was in India, got it stamped on my passport. But never came to US to work on it. But before the H1 expired i changed my status to H4 and i am in US. Now i have a job offer, the company is ready to do H1. My question is can i get H1 done now without being subjected to CAP. If yes what are the steps that i need to follow.

    would appreciate a response

    It makes no difference. You WILL be subject to CAP - check https://www.immihelp.com/usa-h1-visa/ for those that do not.

    And H1s are all accounted for this year - try in April 2008.
