Travel on H4/H1

hi,

I am currently on H4 and my H1 got approved this time. I want to go to INdia in the month of October. We are planning to apply for EAD this July.
Could anybody tell me if I could come back in to this country in November on H4, use my H1 from then on or should I apply for advance parole ? I am really confused!

If you come back on H4 then your status would be H4 and you cannot start using H1 or work without either exiting the country and having H1 stamped and entering on that or applying for COS from H4 to H1 and getting approval for that. So get H1 stamped in India if you want to use H1 to work.


If you want to use EAD to work then you can enter using valid H4 stamp and I-485 receipt without the need for AP. But your status in that case will be AOS not H1.

Thanks for the quick reply. i dont understand what AOS means. Nor COS. please expand them for me. I understand that AP if advance parole.
