H-1B to L2 and back to H-1B

  • H-1B to L2 and back to H-1B

    Hi All,

    I need your valuable advice here on this situation.

    Right now I am on H-1B and being layed off.
    My spouse is on L1 so I have an option to go on L2. (My name is not in his passport)
    Till I find a new employer to hold my H-1B, is is possible for me to be on L2.
    Later to switch back to H-1B (Same petition) after some break say 3-4 months.

    Will my H-1B be still valid in absence of any employer?

    Please help me if someone is aware of this scenario.

    ---- Yes, you can be on L2

    Later to switch back to H-1B (Same petition) after some break say 3-4 months.

    ---- No, you cannot hold the same petition. You will have to apply for a transfer

    Will my H-1B be still valid in absence of any employer?

    ---- H1 is issued to an employer. No second thoughts about it. You are only a candidate serving the H1 as an employee. If you look at H1 you will see that the petitioner is the company and you are the beneficiary

      So as if I find another employer while I am on L2, I am good to be back on H1-- Is this what you say?

      Is there a time period which plays a role here?

        ---- There is no time period as such until you complete the 6 year term on H1, irrespective of whether you are gainfully employed or not

          If I take a break, which pay stubs will I need to show for H1 transfer later?

          And being on L2 I again have option of working with EAD no right?

            ---- The previous paystubs when you were gainfully employed adn if you are working on L2 then teh pay stubs of L2 to show that you were employed, earning adn paying taxes

            And being on L2 I again have option of working with EAD no right?

            ---- Yes, provided you apply for EAD

                  ---- All this time in all your posts you were asking for a change from L2 to H1. Now you are turning the plate around and seeking H1-L2

                  ---- Are you going to stay in one type of Vis or you are going to shift around depending on your convenience and comfort. DEcide these matters and then post your queries

                    Hi,
                    Here is the situation.

                    As I am layed off, I am willing to go on from H1 to L2,
                    Later whenever I get the suitable job, I want to switch back to H1 from L2.

                    My questions were around later section which is L2 to H1.

                    So as per convenience and comfort, I would like to switch back to H1.

                    Hope this clarifies.
