Hi All,
My wife came to US on H4 valid till 2010 and recently she got her H1b approval notice with new I-94 attached stated H1b status. Her approval notice stated "Change of status has been approved". But we are not using her H1b as of now.
We have also filled for Green card during month of July and got our EAD and planning to use EAD instead of H1b for easy job availability in her field.
She is planning to go India during November. Since chance for getting advance parol before she will go is pretty negligible my question is Do she need to get H1b stamping or she can use her H4b while coming back in US.
