Retaining H1B Visa without going to US

Hello Group,

I have a valid H1B visa valid from Oct 2007 - Sep 2010. I am not planing to go to US as I am getting good opprounity within India. This new opporunity will include International Travel and US will be a part of it along with some other EU countries. My query is, if I don't go on H1B Visa to US and I plan to go from my current employer, do I need to take L1 Visa? Will I get any problem in getting L1 Visa as I am not using H1B Visa to go to US and work there? Will the value of Passport/H1B visa retained?

You could have let someone else use that H1B.

What do you mean someone else can use his H1B visa? Employer can only inform the USCIS about unused visas.

You may use your L1 without any problems.

What I meant was if an applicant is not interested to work in US, then dont apply for an H1 to start with. That one visa could have helped one of those who got dissappointed in this years lottery.

Well, I never knew what will happen after 6 months. Never thought will get a better oppporunity within India.
