H1 To H4,wants to study

I have been working as a teacher for the pass two years. Iwas on J2. got my my H1 B visa recently approved in oct2007. I resigned from my job in nov2007. I am still on H1B but will soon convert it to H4. I am planning to do my further studies from a community college in the same state. I want to know if I will be considered as In state student or out of state student for my education. I have also been filing for taxes for the past two years.
