  • H1-b Cap Exemption for Teachers

    Does anybody have information about the possible exemption of US Public School teacher/beneficiaries of an h1-b visa. I have an approved offecr to teach in the New York City Public Schools start Sept 2004. However it appears I did not make the 2004 cap. My immigration lawyer tells me that this means that my application will be re-applied on April 1 which the earliest time an application can be filed for a visa start date of October 1,2004. However, there is some rumor that public school teachers are not subject the cap. Does a public school fall within the category of "affiliated non-profit of higher learning institutions?"

    should be

    A public school is at least a non-profit organization which should be exempted from the HY2004 65,000 cap.

    Why not give it a try if you don't have any other options?
