    Hi,

    I am currently working for a non profit organization and am not subject
    to the caps. The organization has filed for an H1-B1 visa and incurred all
    the necessary charges for filing the petition. They have filed for the
    maximum allowed which is 3 years as they want me to stay on. In my offer letter, there was no stipulations or contracts made. Can the organization processing my H1-B1 include certain stipulations in the visa application process that ensures that I stay for the 3 years or pay a certain percentage of the charges back to them in case I were to leave.

    The lawyer handling this works for the organization. If I were to leave
    what is the general process to transfer my H1-B1. Can I inform the lawyer to do that and not mention this to my current employeer?

    Also once I get my H1-B1 visa, can I go to Canada to stamp my passport or would I need to go back to my native country? What documents are required. I plan on traveling home and would like to get my visa stamped on my passport so that I can come back.

    H1 visa and contracts are 2 separate things. If you sign a contract that if
    you leave before certain period, you will pay so and so, you have to.
    Otherwise, you don't have to.

    Yes, you can go to Canada for stamping if you have never been out of status
    in US.
