  • Need help for stamping in Mexico:



    Dear All ,
    i am staying in USA on F2 Visa . Recently i applied for H1B for 2009 Quota which starts from Oct 2008. Incase if my petetion got approved . then can i able to get stamping from mexico without joining my employer. i mean with out starting my work in the company ? or do i need to wait until i get my paystubs? please help me

    I assume that your employer applied for a Change of Status (from F2 to H1) along with H1. In this case, your status changes from F2 to H1 on Oct 1st and you must get paid from this day on.


    If you go for stamping before Oct 1st, no pay stubs are needed obviously because you haven't started working yet. In this case, you can only enter the U.S. upto 10 days before Oct 1st.

    If you go for stamping after you start working (i.e. Oct 1st), pay stubs are needed.

    So. the answer depends on when you go for stamping and whether or not your employer applied for a Change of Status (from F2 to H1).

      Thank you for your Reply....... so is it possible for me to go for stamping in the last week of september 08 . so that i can enter USA with out any problem and continue my work here...Thank you in advance..

        You mean "start working" and not "continue working", right? I hope you are not engaged in work without authorization.

        Yes, you can go last week of Sept. and enter on/after Sept. 21 and start working on Oct 1st. If your H1 is approved with a COS, you need not go for stamping if you do not want to. Your status changes on Oct 1st and you can start working without the stamp in this case.

          Thank you very much DMx....
          But i would like to go for stamping in the last week of september. since then after it is easy for me to visit inda Incase if any Emergengy. so if i want to go for stamping as i said ...is it easy to get stamped without starting work. can i able to get stamped my passport succesfully??? thank you very much for ur Quick responce eagarly waiting for ur answer...for this one.
