H1b -> B1 ->H1b out of status ?

My H1b expired on Nov 10th 2000. I applied for a B1 (on Oct), and now have an offer from a company to start working. They will sponcer the H1B.
My question is: can I start working at the time the H1B is applied, or do i need to wait untill the H1B is approved ?

No, you can not start working. You have to wait you new H1B approved. The new AC21 (based on S2045) law can not help you in your case.
