help with I-94

  • help with I-94

    I am on L1B visa in US and my wife is on L2. Both of our I-94 had expired on May 25, 2008. We applied for L1B Petition extention on May 9th and we got approval notice and also got new i-94 for both me and my wife on July 2nd 2008. Meanwhile my wife had left for India on June 11th.

    My question is, since uscis gave a new I-94 for my wife while she is in India will there be any problem when she goes for a new L2 visa stamping or when coming to US at "Port of entry". Her new i-94 that we have received will never be returned at "port of exit" as she is already in India.

    Please advise.

    I want to say...

    No problem in L2 stamping. She will need your extension approval notice among other things. After L2 visa has been obtained, she can enter with the visa and your approval notice making sure that her I-94 expiration date is the same as your petition/I-94. This way, yours and her I-94 will have same dates.

    You can forget about the I-94 that came with her extension.
