  • H4 to H1 not typical

H4 to H1 with a twist in the story:

    1 Apr 2008: Filed for H1
    15 Apr 2008: Got Married
    17 Apr 2008: H4 Visa Issued
    20 Apr 2008: Entered USA
    15 May 2008: H1 Approved
30 May 2008: Received the Approval Notice

    Question:
Do i need to leave the country and come back with an H1 Visa to start working, or can i go to the Social security office with the Approval Notice and get SSN and start working?

    Regards,
    Kalyan Verma

What is the twist? You need to either have the employer file an amendment (COS) to change to H1b without leaving US or travel, get a visa stamp and enter.

In both cases, you cannot apply for SSN unless the H1b COS is approved and you have an I-94 representing H1 status.

I am not a lawyer and you need to consult with one to validate any info posted on the forum and discuss your case specifics. H1b Question? Read the FAQ first.

Typically H4 visa holders file for H1 while they are in the USA. Thats not the case for me. However you answered my question, thanks a million.
