  • H1B stamping in Delhi

I have done my masters in US and am currently on OPT and am going to India in Sept for getting married. My H1B was also approved with start date of 1st Oct whereas my OPT ends on 30th Sept but I am entering US on 24th Sept (Just a week before ending of OPT and starting of H1B). Please suggest if I should enter US on F1 or H1i.e. should I go for H1 stamping in Delhi or should I enter US on F1 (valid till Oct 09) and go for stamping to Canada or Mexico? I am asking this question to avoid any visa issues in Delhi since I have the option to enter US on F1 anyways.

Enter on H1 if at all possible so that it will be easy for your spouse to get H4. Both of you can go for stamping. You can also enter on F1 based on Efren Hernandez memo.

I am not a lawyer and you need to consult with one to validate any info posted on the forum and discuss your case specifics. H1b Question? Read the FAQ first.
