  • L1(expiring) to H4

I am working for a reputed Indian firm on H1b. My wife is working in the same firm on L1b. Her project gets over in Sep and she may have to leave US. However, she wants a break and hence I am planning to change her L1 to H4 visa after applying for some nonpaid leaves, say 3-6 mths.
My problem is that her current L1b expires in Feb 2009 and thereafter when she returns to work, she will be requiring to extend L1b.
Could there be a problem in her L1 extension due to the career gap she wd have taken during these holidays?
Can she safely apply for extension after Feb 2009 along with COS H4 to L1?

    Thanks in advance

Is she going to be on H4 during her LOA? If so, USCIS may not have any issues when it comes to L1 renewal. It will be a COS renewal though.

I am not a lawyer and you need to consult with one to validate any info posted on the forum and discuss your case specifics. H1b Question? Read the FAQ first.
