L1 to H1 (COS), is leapfrog required in my case?

  • L1 to H1 (COS), is leapfrog required in my case?

    I am on L1 with company A, I got H1B approved with COS from company B. since my project with company A is not getting over by 30 oct, I have to work for company A (which is not legal coz of my H1B with COS). After going through all related thread I found that I have an option of doing Leapfrog to get I-94 for my current L1. Reason my be the I-94 number I received with COS petition is same as the one I received when I entered with L1 for comp A.
    But I had to travel to my home country when the petion was pending for approval ( they took my I-94 while going back). My petition got approved on 11th of July and I came back on 13th of July. So I have new I-94 (obiviuosly for my current L1), which is different from one with H1B approval notice (COS). I think leapfrog is required coz new H1B I-94 hacks your L1 I-94 (submitted by you while applying for H1B cos) and put the H1B name on it and changes the validity dates.

    Question: Since I got the new I-94 for my current L1, still I need to do the Leapfrog to work for company A till the project ends?

    Your travel and re-entry on a pending petition has voided your COS. You need not do leapfrog. Consult your attorney for double clarification.
