If in 2007 H1B was approved with COS then she is out of status since last year.
If this is the case then see a good attorney.


If it wasn't approved COS then, she can apply for COS now from H4 to H1 and upon approval she can start working.

if H1B is approved with COS, then he/she should start working with the employer from Oct 1st.

My wife was on H4 status till her H1 was approved last year(2007). She did not start working yet on H1. Is there any rule that one has to start working within certain period of time after they get H1 ? Is it possible to change her status back to H4 now ?
