    Travel while H1 is under extension process

    Hello

    One of my friend need to travel to India. He is planning to come back from India on 1st of Sept 2008.

    The problem he has is that, his H1 is expiring on 1st of Oct 2008. He has already applied for his extension and waiting for approval.

    Is it ok for him to enter back into the country on Sept 1st when his visa expires on Oct 1st?

    Please clarify.
