    Hi,

    I got my H1b approved last year and now I wish to go for my VISA stamping. Since last 2 months, I am on bench and my company doesn't run my payroll during this time.
    My question is - Can I still go for stamping based on my 2 months prior pay stub?
    Please advice, If this would be safe or I should wait till I get another project and subsequent pay stubs.

    The law does require one to be paid all the time on H1b visa. Your employer is violating the law. Demand for your pay or complain to DOL on a WH4. Not getting paid has put you out of status and will have serious consequences in the future when time comes.
