Pending H1 aaproval, transfer H1 and visa stamping

Hello,

The company that I work for has applied for my H1 extension around 2 months ago. My current H1 is valid till Sep 20 2008 and I94 is valid till Oct 14 2008.

I've the following questions:

1) I'm not sure when my H1 will be approve by USCIS. Suppose if my H1 gets approved after Sept 20. Will I be Out of status and accumulate illegal status of stay in the US ?

2) Suppose if my H1 gets approved after Oct 14. Will I be Out of status and accumulate illegal status of stay in the US ?

3) After my H1 gets approved, I'm planning to transfer my H1 to some other company, can I do this even if my extended H1 is not stamped ?

4) What is the best time of the year to transfer H1 ?

5) What points should a person note before transferring H1 to some other company ?

1. No as you have a pending EOS filed with USCIS before your I-94 expired.

2. I-94 date is what is important in general. See #1.
