Employer not sending H1 approval - Can i complain DOL from india

Hi,

I do have the original I-797 petition with me and also photocopies of other documents required for VISA stamping.

Only, under 221-g cases...when asked for more genuine documents...these organisations tend to give a slip.

The fact that he has sent some of these documents for stamping....itself is an indicator that he wants to hire me.

When something is not clear with the employer, why not USCIS or DOL take action on these organsations who have defaulted.....if they donot show up with the documents asked...

Tell me is this fair...

It is fair for the company to rescind an offer at any time. It is you that paid for the H1b knowing it is illegal.If you have proof of payment, complain to DOL on a WH4 form.
