H4 Transfer??

  • H4 Transfer??

    Hi

    I had H1 with company A and my wife and kid have H4s. I joined a new employer and got the approval notice for H1 transfer from A to B.
    Do i need to do any transfer for their H4 since i joined a new company ?

    please advice

    Hi,

    H4 Visa depends on the Principal Applicant legal Status and not on the Employer.
    So you don;t have to transfer H4.

    But make sure that I-94 attached to their passports should be valid and if it is expiring soon then get it extended for them by filing FORM:I-539.

      thanks bro! the I-94 is not expired yet. Just another question on this, will there be new LCA for the H1 transfer?

          Abhay has helped already. Every H1b needs a LCA.

            Hi,
            As already mentioned by txhb1 ,that every H1B needs a LCA.

            So you should have a NEW LCA papers and I-129 (Photocopy) with you - it will be needed when you or your family goes for stamping again in India in future.
